The following felony cases were decided in Pittsburg County District Court July 22 to 24. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.

• Shell Wayne Tidwell, 24, of Savanna, pleaded guilty July 24 to omitting to provide for minor child and judgment and sentencing were deferred for five years. He was ordered to pay $17,987.45 in restitution, and the sentencing was ordered served concurrent with sentencing in a separate misdemeanor case.

• Jeffery Freeman, 40, of McAlester, pleaded guilty July 24 to a reduced charge of possession of a controlled dangerous substance, methamphetamine, and was sentenced to 12 years, with another eight suspended. The sentencing was ordered served concurrent with sentencing in another case, and the charge was reduced from possession of a controlled substance, methamphetamine and marijuana. Also, charges of manufacturing methamphetamine, possession of a controlled dangerous substance without a tax stamp affixed and misdemeanor possession of drug paraphernalia were dismissed. The charges had been filed with the prior conviction enhancement for two 2004 drug possession convictions resulting in sentences of five years, with another seven suspended; and a 2002 drug possession conviction resulting in a three-year sentence.

• Sarah Elizabeth Wright, 27, of Savanna, pleaded guilty July 24 to possession of a firearm after a felony conviction and misdemeanor threatening to perform an act of violence. A two-year sentence was suspended in a plea bargain approved by the victim in the case.

• Curtis Lee Gilpen, 44, of McAlester, pleaded no contest July 24 to leaving the scene of a personal injury accident and misdemeanor driving while under the influence of alcohol and transporting an opened container of beer. A two-year sentence was suspended, to be served concurrent with sentencing in a separate felony case, and he was fined $700. He was also ordered to seek and comply with the recommendations of a drug and alcohol evaluation, attend DUI school and a Victim’s Impact Panel, and use an ignition interlock device.

• In a separate case, Gilpen pleaded guilty July 24 to an application to accelerate deferred sentencing on a charge of malicious injury to property valued at over $2,500. Judgment and sentencing had been deferred for five years and he was ordered to pay $2,337 in restitution, but in 2008 an application to accelerate was filed because he was arrears $357.10 on restitution. The application was dismissed in February, and another was filed July 22 because he was charged with driving while intoxicated, leaving the scene of an accident and transporting an opened container of beer. In his July 24 plea, a two-year sentence was suspended, to be served concurrent with sentencing in another felony case. Restitution was ordered to remain intact and he was ordered to obtain a drug and alcohol evaluation and comply with its recommendations, attend DUI School and a Victim’s Impact Panel, and obtain an ignition interlock device.

• Rachael Dawn Lenardo, 29, of McAlester, pleaded guilty July 24 to child endangerment and misdemeanor aggravated driving a motor vehicle while under the influence of alcohol, and leaving the scene of an accident involving damage. Judgment and sentencing were deferred for five years, she was fined $400 and restitution in the case was reserved. Additionally, she was ordered to obtain and comply with the recommendations of a drug and alcohol evaluation, attend a Victim’s Impact Panel, DUI school and parenting classes, and seek 28 days of treatment and follow up with random urine drug tests, all within 60 days. Dismissed were misdemeanor charges of failure to maintain security, driver’s license to be carried and intersection violation.

• Charges of possession of a controlled substance, marijuana, within 1,000 feet of a park, and misdemeanor possession of drug paraphernalia were dismissed July 24 for Bradley Allen Crider, 25, of McAlester.

• Keith Alan Creekmore, 46, of Checotah, pleaded guilty July 24 to larceny of merchandise from a retailer and judgment and sentencing were deferred for five years. The plea was approved by the victim in the case.

• Grant Spencer Hurt, 19, of McAlester, pleaded guilty July 24 to knowingly concealing stolen property, second degree burglary of an automobile, and four counts of second degree burglary. Judgment and sentencing were deferred for five years and restitution in the case was reserved.

• Charges of failure to register as a sex offender, sex offender living within 2,000 feet of a daycare, and misdemeanor driving without a license were dismissed July 24 for Donald Robert Gill, 45, of McAlester, at the request of prosecutors.

• Charges of domestic abuse, assault and battery, and misdemeanor possession of a controlled substance, marijuana, obstructing an officer and public intoxication were dismissed July 23 for Christopher Paul Love, 32, of McAlester. The charges were dismissed at the request of prosecutors because the alleged victim in the case refuses to return to Oklahoma. The charge had been filed with the prior conviction enhancement for a 2001 conviction for domestic assault and battery resulting in a two-year suspended sentence.

• Another case was also dismissed for Love on July 23. Two counts of domestic abuse, assault and battery, and misdemeanor harassing and threatening communication by e-mail were dismissed, also at the request of prosecutors because the alleged victim in the case refuses to return to Oklahoma. The charge had also been filed with the prior conviction enhancement for a 2001 conviction for domestic assault and battery resulting in a two-year suspended sentence.

• A third felony case was also dismissed for Love on July 23. The charge of domestic abuse, assault and battery, was dismissed, also at the request of prosecutors because the alleged victim in the case refuses to return to Oklahoma. The charge had also been filed with the prior conviction enhancement for a 2001 conviction for domestic assault and battery resulting in a two-year suspended sentence.

• Daniel Cadena, 20, of Dallas, pleaded guilty July 22 to possession of a controlled substance with intent to distribute, possession of a controlled dangerous substance without a tax stamp affixed, and misdemeanor driving while his license is suspended. He was sentenced to five years and was fined $2,200.

• Christopher Lee Kramer, of Savanna, pleaded guilty to contempt of court in a 2001 bogus check case. He was sentenced to 120 days in jail, with another two months suspended, to be served concurrent with sentencing in two other misdemeanor cases.

• Bobby Eugene Waller, Jr., 20, of McAlester, pleaded guilty July 22 to first degree robbery and misdemeanor possession of a controlled substance, marijuana. He was sentenced to 10 years in prison, with another 10 suspended, and he was fined $1,000. The sentencing was ordered served concurrent with sentencing in a separate misdemeanor case.



The following misdemeanor cases were decided in Pittsburg County District Court July 21-27. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.

• Michael Lynn Tutor, 31, of Siloam Springs, Ark., pleaded guilty July 27 to driving with a suspended license and he was fined $300.

• David Gonzalez-Alvarez, 23, of Oklahoma City, pleaded guilty July 27 to driving without a driver’s license and he was fined $50.

• Shannon Knight, of McAlester, pleaded guilty July 27 to a bogus check charge and judgment and sentencing were deferred for six months. Knight was also ordered to pay $984.16 in restitution.

• A bogus check charge was dismissed July 27 for Della Marie Pebsworth, 30, of Eufaula.

• Bradley Allen Crider, 25, of McAlester, pleaded guilty July 24 to failure to devote attention to driving while involved in an accident. A 90-day sentence was suspended and he was fined $100. Restitution in the case was reserved.

• Latia D. Humston, 31, of Pauls Valley, pleaded guilty July 24 to failure to wear a seat belt and was ordered to pay the scheduled fine. A charge of driving while her license is suspended was dismissed because Humston had obtained a driver’s license.

• Tommy Allen McCombs, 24, of McAlester, pleaded no contest July 24 to illegal possession of an endangered species, an alligator, and was ordered to pay the scheduled fine.

• Lydia Hutchings, 51, of McAlester, pleaded guilty July 24 to aggravated driving a motor vehicle while under the influence of alcohol and driving while her license is suspended. She was sentenced to 20 days, with the remainder of a one-year sentence suspended, and she was fined $600. Restitution in the case was reserved. Also, 480 hours of community service were suspended, she was ordered to attend a Victim’s Impact Panel within 60 days, to seek a drug and alcohol evaluation within 30 days and comply with its recommendations, and to obtain an ignition interlock device within 30 days.

• James Michael Simon, 48, of Eufaula, pleaded guilty July 24 to operating a motor vehicle without the license required for the type of vehicle operated (commercial vehicle). He was fined $50.

• Shell Wayne Tidwell, 24, of Savanna pleaded guilty July 24 to driving a motor vehicle while under the influence of alcohol and driving while his license is revoked. Judgment and sentencing were deferred for two years, to be served concurrent with sentencing in a felony case, and he was fined $300. Additionally, Tidwell was ordered to obtain a drug and alcohol evaluation and comply with its recommendations, attend a Victim’s Impact panel and DUI School, and obtain a 90-day ignition interlock, all within 60 days. The plea bargain was approved by the alleged victim in the case.

• A charge of permitting an employee to operate a motor vehicle without a valid license for class was dismissed July 24 for Robert A. Hooten, 49, of Eufaula, at the request of the Oklahoma Highway Patrol.

• Charges of driving a motor vehicle while under the influence of alcohol, leaving the scene of a property damage accident and transporting an opened container of beer were dismissed July 24 for Curtis Lee Gilpen, 44, of McAlester. The charges were to be re-filed as a felony case.

• Johnny Joe Lardi, 59, of McAlester, pleaded no contest July 23 to driving while his license is revoked and failure to wear a seat belt. A one-year sentence was suspended and he was fined $220.

• Christopher Glenn Blunt, 33, of Claremore, pleaded guilty July 23 to larceny of merchandise from a retailer. Judgment and sentencing were deferred for two years and he was fined $100.

• A bogus check charge was dismissed July 23 for Cody Pollard, 24, of Spring, Texas.

• Sandra L. Beard, 36, of Stigler, pleaded no contest July 22 to driving without a valid driver’s license and failure to wear a seat belt and she was fined $70.

• Amber D. Autrey, 20, of McAlester, pleaded guilty July 22 to a bogus check charge and judgment and sentencing were deferred for one year.

• Teena Marie Warren, 37, of Eufaula, pleaded guilty July 22 to driving with a suspended or revoked license, altering a license plate or decal, and speeding. Judgment and sentencing were deferred for six months and she was fined $220.

• A bogus check charge was dismissed July 22 for Brandy Paulsen, of McAlester.
