Aug. 23, 2009: Pittsburg County District Court Dispositions

The following felony cases were decided in Pittsburg County District Court Aug. 7-17. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.

• Joseph Jerome Feinberg, 40, of Jackie Brannon Correctional Center, was found guilty Aug. 17 by a jury for escaping from the Department of Corrections on Nov. 6 while serving a sentence for lewd molestation of a child. He testified, along with five state witnesses, and jurors spent 11 minutes deliberating before returning the guilty verdict. He was sentenced to four years, to be served consecutive to his current sentence.

• Tyler Devin Mann, 20, of Checotah, pleaded guilty Aug. 14 to assault and battery with a dangerous weapon, and misdemeanor driving a motor vehicle while under the influence of alcohol, possession of marijuana and leaving the scene of an accident involving injury. He was sentenced to 10 years, including one year in the county jail, to be served concurrent with sentencing in another felony case. Restitution in the case was reserved, and he was ordered to obtain drug and alcohol abuse education and anger management education while incarcerated.

• Mann also pleaded guilty Aug. 14 to injuring a public building and was sentenced to 10 years, to be served concurrent with sentencing in another felony case. Restitution in the case was reserved.

• Leslie Gene Osborne, 49, of McAlester, pleaded guilty Aug. 14 to possession of a controlled substance and misdemeanor possession of drug paraphernalia and failure to pay taxes due the state. A five-year sentence was suspended, with a year to be served under the supervision of community sentencing. He was also fined $20. The charge was filed with the prior conviction enhancement for two drug cases in 1997 and 1998, each resulting in deferred sentences.

• Paul E. Freeman, of Atoka, pleaded guilty Aug. 14 in a bogus check case and a one-year sentence was suspended. He was also ordered to pay $416.33 in restitution.

• Charlotte L. Holstine, 32, of Stringtown, pleaded guilty Aug. 14 on an application to revoke deferred sentencing for possession of a controlled substance, methamphetamine, and misdemeanor possession of drug paraphernalia. A 10-year sentence was suspended and she was ordered to complete drug court in Atoka County.

• Iris L. Minor, 24, of McAlester, pleaded guilty Aug. 14 to possession of a controlled substance, methamphetamine, within 1,000 feet of a school, and misdemeanor possession of drug paraphernalia. Judgment and sentencing were deferred for five years, and she was fined $250. She was also ordered to obtain and comply with the recommendations of a drug and alcohol abuse evaluation.

• Nicole Elizabeth Charier, 30, of Poteau, pleaded guilty Aug. 14 to attempting to obtain controlled substance by forgery/fraud. Judgment and sentencing were deferred for five years and she was fined $1,000. She was also ordered to obtain and comply with the recommendations of a drug and alcohol abuse evaluation within 30 days.

• Jimmy Don Allen, 43, of McAlester, pleaded guilty Aug. 14 to possession of a controlled dangerous substance, and misdemeanor possession of drug paraphernalia and failure to wear a safety belt. Judgment and sentencing were deferred for three years and he was ordered to pay the scheduled fine.

• A charge of assault and battery with a dangerous weapon was dismissed Aug. 14 for Jose Gonzales, 29, of McAlester, because he has been deported.

• Monte Foreman, 32, of Tulsa, pleaded no contest Aug. 12 to possession of a controlled drug, marijuana, with intent to distribute, and misdemeanor possession of drug paraphernalia and driving while his license is suspended. He was sentenced to five years, with another five suspended, and was ordered to pay the cost of a transcript used in the case. The charge was filed with the prior conviction enhancement for 2002 convictions on drug charges resulting in a prison program, Drug Offender Work Camp, followed by a seven-year suspended sentence. One of the sentences was revoked in 2006 for four years.

• Jason Levi Kirk, 25, of McAlester, was found not guilty Aug. 11 by a jury on his trial for alleged aggravated assault and battery. Six prosecution witnesses testified and jurors deliberated the case for just over three hours before returning the not guilty verdict. The charge had been filed with the prior conviction enhancement for two 2008 convictions on drug charges, and a 2007 conviction for drunk driving, each resulting in prison programs to be followed by suspended sentences.

• Billie J. Hanks, 31, of Checotah, pleaded guilty Aug. 7 to unauthorized use of a motor vehicle and misdemeanor driving while license suspended and careless driving. Hanks was sentenced to a year, with another four suspended, and was ordered to pay $13,177.31 in restitution and $300 in fines.

• William Walton Chambers, 24, of McAlester, pleaded no contest Aug. 7 to destruction of a public building and misdemeanor assault on a police officer, threatening to perform an act of violence and public intoxication. He was sentenced to a year in prison, to be served concurrent with sentencing in another felony case. The charge was filed with the prior conviction enhancement for a 2008 case for illegal possession of a firearm after a conviction or during probation resulting in a three-year suspended sentence.

• A bogus check was dismissed Aug. 7 for Tommy Harold Conner, 34, of Kiowa, on payment of costs. The charge was filed with the prior conviction enhancement for a 1999 conviction for two counts of kidnapping, two counts of robbery and one count of conspiracy, resulting in a 25-year sentence.



The following misdemeanor cases were decided in Pittsburg County District Court Aug. 12-18. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.

• Caleb Daniel Armstrong, 20, of McAlester, pleaded guilty Aug. 18 to resident fishing without a license and was ordered to pay the scheduled fine.

• Lewis Cristal Bell, 46, of Okmulgee, pleaded guilty Aug. 18 to driving a motor vehicle while under the influence of alcohol, driving while his license is suspended and transporting an opened container of beer. Judgment and sentencing were deferred for one year and he was fined $450. He was also ordered to obtain and comply with the recommendations of a drug and alcohol abuse evaluation, and attend DUI school and a Victim’s Impact Panel.

• A charge of public intoxication was dismissed Aug. 12 for Argle Dewayne Jameson, 54, of McAlester.
