Oct. 11, 2009 - Pittsburg County District Court Dispositions

The following felony cases were decided in Pittsburg County District Court Sept. 29 to Oct. 5. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains. Listings do not include any court costs assessed.
Keith A. Jennings, 41, of Oklahoma State Penitentiary, pleaded guilty Oct. 2 to assault and battery with deadly weapon and was sentenced to 10 years, to be served consecutive to his current sentence. The plea agreement was made with the approval of the victim’s family, prosecutors said. Jennings was charged with the prior conviction enhancement for 1991 convictions for rape, burglary, two counts of robbery and auto theft for which he was sentenced to 130 years.
Michael N. Ramsey, 29, of rural McAlester, pleaded guilty Oct. 2 to possession of a firearm after a former felony conviction and feloniously pointing firearm. A five-year sentence was suspended and charges of possession of a sawed-off shotgun and misdemeanor domestic abuse assault and battery were dismissed.
Tommy Lee Boswell, 31, of Broken Bow, pleaded guilty Oct. 2 to exploitation of elderly person and a three-year sentence was suspended. He was charged with the prior conviction enhancement for a 1999 case in Smith County, Texas, for theft in which he was sentenced to two years in prison.
Chasidy R. Washington, 31, of McAlester, pleaded guilty Oct. 2 to second degree burglary and five counts of unauthorized use of credit card. She was sentenced to one year in the Pittsburg County Jail, with another four years suspended. Restitution was reserved and she was given credit for time served. The plea bargain sentence was approved by the victim in the case. Washington was charged with the prior conviction enhancement for a 1998 drug case resulting in a three-year suspended sentence.
Brian Keith Dollins, 45, of Hartshorne, pleaded guilty Oct. 2 to omitting to provide for minor child and judgment and sentencing were deferred for five years. He was also ordered to pay $38,573.73 in restitution.
Eugene J. Espinoza III, 20, of Bixby, pleaded no contest Oct. 1 to possession of controlled drug, Xanax, with intent to distribute and misdemeanor driving with license canceled, suspended or revoked. Judgment and sentencing were deferred for three years and he was fined $500.
Jimmie D. Paxton, 41, of rural McAlester, pleaded guilty Sept. 30 to omitting to provide for minor child and a 15-year sentence was suspended. The victim in the case approved of the plea, according to court records. Paxton was charged with the prior conviction enhancement for four felony convictions: drug possession in 1999, for which he was sentenced to 60 days with the remainder of five years suspended; unauthorized use of a vehicle in 2000, five years suspended; drug possession in 2000, three years with another five suspended; and drug possession in 2002, nine years with another 12 years suspended.
Robyn Renae Peavy, 36, of McAlester, pleaded guilty Sept. 30 to misdemeanor obstruction of justice and judgment and sentencing were deferred for two years. The charge was reduced from felony harboring fugitive from justice, and charges of bringing contraband into jail and misdemeanor possession of controlled substance, marijuana and Xanax, were dismissed.
The following misdemeanor cases were decided in Pittsburg County District Court Sept. 30 to Oct. 7. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains. Listings do not include any court costs assessed.
Dismissed Oct. 7 for Joseph Neal Kennedy II, 18, of Wilburton, was a charge of driving with license suspended.
Dismissed Oct. 5 for Vince V. Vest, 42, of Bonner Springs, Kan., was a charge of driving without a valid driver’s license.
Dismissed Oct. 2 for Tod Clay Lane, 39, of rural McAlester, was a charge of domestic assault and battery in the presence of a minor.
James Leroy Smallwood II, 29, of Savanna, pleaded guilty Oct. 2 to public intoxication and he was fined $50.
Dismissed Oct. 2 for Randy Porfilio, 42, of McAlester, was a charge of obstructing officer and trespassing after being forbidden.
In a separate case, a charge of threaten to perform act of violence was also dismissed Oct. 2 for Porfilio.
David Lee Hamilton, 24, of McAlester, was sentenced Oct. 2 to one year in the county jail for domestic abuse assault and battery and the sentence was ordered served concurrent with sentencing in a felony case. He was also fined $50 and was given credit for time served.
Christopher Thomas Gaston, 29, of Carrollton, Texas, pleaded guilty Oct. 2 to running a roadblock and a five-year sentence was suspended, to be served concurrent with sentencing in another felony case in McIntosh County. Dismissed were charges of eluding or attempting to elude police officer, and driving with license canceled, suspended or revoked. Gaston was charged with the prior conviction enhancement for a 1998 case in Clayton, Mo., for unlawful use of a weapon and causing property damage in which a three-year sentence was suspended and later revoked; and a 2001 case, also in Clayton, for stealing in which he was sentenced to one year.
Christopher Shannon McLennan, 21, of Pittsburg, pleaded guilty Oct. 2 to an application to accelerate sentencing on a charge of accessory after the fact and was sentenced a year in the county jail, with another four years suspended. The sentencing was done with the consent of the victim in the case.
Jasper K. Thomas Jr., 25, of rural Eufaula, pleaded no contest Oct. 1 to driving without a driver’s license and he was fined $50.
A bogus check charge was dismissed Oct. 1 for Vickie Lynn Cantrell, 35, of Oktaha, on payment of costs. Restitution and court costs in the case have been paid in full.
Dana Bevins Williams Jr., 37, of McAlester, pleaded guilty Sept. 30 to driving without a driver’s license. He was fined $50 and a charge of failure to carry insurance or a security verification form was dismissed.
James E. Terpstra, 34, of Wilburton, pleaded guilty Sept. 30 to a bogus check charge and judgment and sentencing were deferred for one year. He was also ordered to pay $275.45 in restitution.
James W. Irving III, 46, of McAlester, pleaded guilty Sept. 30 to driving with license suspended and judgment and sentencing were deferred for 90 days. He was also fined $100.
Michael P. London, 47, of rural Checotah, pleaded guilty Sept. 30 to driving with license suspended and judgment and sentencing were deferred for 90 days. He was also fined $300.
John David Mattioda, 43, of Hartshorne, pleaded no contest Sept. 30 to transporting opened container of beer and judgment and sentencing were deferred for 90 days. He was also fined $150.
A bogus check charge was dismissed Sept. 30 for Sondra Beck, 40, of McAlester because the merchant had been paid but turned the check over for collection by mistake.
A charge of operating a motor vehicle in a manner not reasonable and proper was dismissed Sept. 30 for Charlie S. Clifton, 81, of McAlester.
